    Sponsored by Rep. Dennis Baxley and Sen. Anitere Flores, but defeated in the Nov. 6, 2012 election, Amendment 6 would amend the Florida Constitution to prohibit public funds from being expended for any abortion or for health-benefits coverage that includes coverage of abortion. Amendment 6 also prohibits the Florida Constitution from being interpreted to create broader “privacy rights” to an abortion than those contained in the U.S. Constitution, thus restoring parental control over abortions to minors in the state of Florida. The amendment seeks to overturn a Florida “privacy” court ruling through which pregnant minors may obtain abortions without parental knowledge or consent.

    Florida first state to enact “stand your ground” gun law

    Sponsored by Rep. Baxley, and signed into law in 2005, SB436 (substitute HB249) is the first “Stand Your Ground” law in the United States. SB436 (Chapter No. 2005-27 -SJ 00585) authorizes a person to use force, including deadly force, against an intruder or attacker in a dwelling, residence, or vehicle under certain circumstances; creates a presumption that a reasonable fear of death or great bodily harm exists; creates a presumption that a person acts with the intent to use force or violence; provides that a person is justified in using deadly force under certain circumstances; and declares that a person has no duty to retreat and has the right to stand his or her ground and meet force with force in certain circumstances.
