Howell, Canterbury, et al, HB2554 (the “Intrastate Coal and Use Act”) establishes that the environmental regulation of coal and certain coal products mined and used within the state is exclusively regulated by the West Virginia Department of Environmental Protection, and is not subject to federal interstate commerce regulations. Other states well situated for the Intrastate Coal and Use Act include top 20 coal producing states (WY, KY, PA, MT, TX, IN, IL, ND, OH, CO, VA, NM AL, UT, AZ, MO, MS, LA, MD).
