Nieves, SB265 states, “Neither the state of Missouri nor any political subdivision shall adopt or implement policy recommendations that deliberately or inadvertently infringe or restrict private property rights without due process, as may be required by policy recommendations originating in, or traceable to Agenda 21, adopted by the United Nations in 1992 at its Conference on Environment and Development or any other international law or ancillary plan of action that contravenes the Constitution of the United States or the Missouri Constitution.”

Missouri legislature bans foreign law from use in state courts

Sponsored by Sen. Nieves and Rep. Curtman, SB267 creates the “Civil Liberties Defense Act” mandating that any court, arbitration, tribunal, or administrative agency ruling shall be unenforceable if based on a foreign law that does not grant the parties the same rights as the parties have under the United States and Missouri constitutions, including, but not limited to, due process, freedom of religion, speech, or press, and any right of privacy as specifically defined by the constitution of this state.

Missouri to ban warrantless use of spy drones in state

Sponsored by Rep. Guernsey, HB46 states that no person, entity, or state agency shall use a manned aircraft, drone, or unmanned aircraft to gather evidence or other information pertaining to criminal conduct or conduct in violation of a statute or regulation except to the extent authorized in a warrant. In addition, drones may not be used to conduct surveillance or observation under the doctrine of open fields of any individual, property owned by an individual, farm, or agricultural industry without the consent of that individual, property owner, farm or agricultural industry. Finally, drones may not be used to conduct surveillance of any individual or property owned by an individual or business without the consent of that individual or property owner.

Missouri to back out of federal ‘Common Core’ school curriculum

Bill: HB616 (PDF) SB210 (PDF)

Sponsored by Rep. Kurt Bahr and Sen. John Lamping, HB616/SB210 states, “The state board of education shall not adopt, and the department of elementary and secondary education shall not implement, the Common Core State Standards developed by the Common Core Standards Initiative. Any actions taken to adopt or implement the Common Core State Standards as of the effective date of this section are void. Common Core State Standards or any other statewide education standards shall not be adopted or implemented without the approval of the general assembly.”

Missourians expected to vote on photo voter ID amendment in 2014 election

Bill: HB48 and HJR5 (PDF)

Sponsored by Reps. Duggar and Cox, HB48 and HJR5 call on Missourians to vote for a constitutional amendment requiring secure and fair elections through the use of photo voter ID. HJR5 states, “A person seeking to vote in person in public elections may be required by general law to identify himself or herself and verify his or her qualifications as a citizen of the United States of America and a resident of the state of Missouri by providing election officials with a form of identification, which may include requiring valid government issued photo identification.” If approved by the legislature, the ballot measure would be scheduled for a statewide vote in November 2014.

Missouri lawmakers back bill to deny federal gun control laws in state

Bill: HB170 (PDF)

Sponsored by Reps Guernsey, Curtman, and 60 other co-sponsors, HB170 specifies that a federal official must not enforce a federal firearm law when the firearm is manufactured and remains in the state and that any new federal law banning or restricting ownership of a semi-automatic firearm is unenforceable. Violators shall be guilty of a class D felony with a prison sentence of up to four years.

Missouri to deny unlawful detention of U.S. Citizens under National Defense Authorization Act

Bill: HB57 (PDF)

Sponsored by Reps Fitzpatrick, Miller and Curtman, HB57 would deny the the illegal detention of U.S. citizens and suspension of habeas corpus prescribed by the National Defense Authorization Act (NDAA). HB 57 states that “no state agency, political subdivision, employee of such state agency or political subdivision acting in his or her official capacity, or member of the Missouri National Guard on official state duty, shall knowingly aid an agency of the armed forces of the United States in the detention of any citizen pursuant to 50 U.S.C. Section 1541 as provided by the National Defense Authorization Act for Fiscal Year 2012.” Missouri HB57 is based on the Virginia anti-unlawful-detention law (Va. Acts of Assembly Chapter 792) passed in 2012.

Missouri passes public prayer constitutional amendment

Sponsored by Rep. Mike McGhee, and approved by voters on August 7, 2012, HJR2 (The Missouri Public Prayer Amendment) amends the state constitution to guarantee a citizen’s right to pray and worship on public property. The amendment states that the right of Missouri citizens to express their religious beliefs shall not be infringed, and that school children have the right to pray and acknowledge God voluntarily in their schools.

Missouri allows citizens to refuse Obamacare contraception-abortion mandate

Sponsored by Sens. Lamping, Dempsey, Kehoe, et al, and passed into law by a successful override of Governor Nixon’s veto, SB749 mandates that no employee, self-employed person, or any other person shall be compelled to obtain coverage for, or be discriminated against or penalized for declining or refusing coverage for, abortion, contraception, or sterilization in a health plan if such items or procedures are contrary to the religious beliefs or moral convictions of such employee or person.

Missouri law mandates suspicion-based drug tests for welfare recipients

Sponsored by Rep. Ellen Brandom and signed into law by Gov Jay Nixon, HB73 mandates that residents who receive welfare through Temporary Assistance for Needy Families (TANF) Program must be screened for illegal drug use and could lose their benefits. Welfare recipients who refuse to be checked, and those who test positive and do not complete a substance abuse program, will be ineligible for benefits through the welfare program for three years.

Missouri amendment to give governors control over judicial selection process

Sponsored by Sen. Jim Lembke and Rep. Stanley Cox, but defeated in the Nov. 6, 2012 election, SJR51 is a legislatively-referred constitutional amendment that puts the selection of Supreme Court and appellate court nominees strongly in the hands of the elected Governor of the State. Under the proposed amendment, the governor would appoint four of the seven commissioners who choose nominees for the Court of Appeals and the Missouri Supreme Court. The amendment aims to end a longstanding judicial nomination process dominated by unelected liberal trial lawyers.

Curtman, Jones, Koenig, et al., HB1512 (The “Civil Liberties Defense Act”) states that “it shall be the policy of this state to protect its citizens from the application of foreign laws when the application of a foreign law will result in the violation of a right guaranteed by the constitution of this state or of the United States, including, but not limited to, due process, freedom of religion, speech, or press, and any right of privacy.”

Missouri pursues Sound Money Act to restore gold-silver money use

Sponsored by Reps Curtman, Koenig, Bahr et al., HB1637 would establish the “Missouri Sound Money Act of 2012,” which states that gold and silver issued by the federal government is legal tender. In addition, exchange of gold and silver as legal tender is exempted from state and local sales and use taxes, and also from state individual and corporate income taxes.
