Sponsored by Rep. Michael Noel, and signed into law in 2013 by Gov. Herbert, HB155 limits the authority of federal employees to exercise law enforcement authority within Utah. HB155 provides that Utah does not recognize the authority of any United States Forest Service employee who is not a certified law enforcement officer or any Bureau of Land Management employee to exercise law enforcement authority under state, local, or federally assimilated law. Violators of this law are guilty of a class B misdemeanor punishable by a $1,000 fine and six months in jail.

Boots, and signed into law in 2013 by Governor Pence, SB0213 (Public Law 88) states, “Unless federal or state law provides otherwise, a unit may not establish, mandate, or otherwise require an employer to provide to an employee who is employed within the jurisdiction of the unit: (1) a benefit; (2) a term of employment; (3) a working condition; or (4) an attendance or leave policy; that exceeds the requirements of federal or state law, rules, or regulations.”

Nieves, SB265 states, “Neither the state of Missouri nor any political subdivision shall adopt or implement policy recommendations that deliberately or inadvertently infringe or restrict private property rights without due process, as may be required by policy recommendations originating in, or traceable to Agenda 21, adopted by the United Nations in 1992 at its Conference on Environment and Development or any other international law or ancillary plan of action that contravenes the Constitution of the United States or the Missouri Constitution.”

Curtman, SB267 creates the “Civil Liberties Defense Act” mandating that any court, arbitration, tribunal, or administrative agency ruling shall be unenforceable if based on a foreign law that does not grant the parties the same rights as the parties have under the United States and Missouri constitutions, including, but not limited to, due process, freedom of religion, speech, or press, and any right of privacy as specifically defined by the constitution of this state.

Steve Toth, HB1076 (the “Texas Firearms Protection Act”) would make any federal law banning semi-automatic firearms or limiting the size of gun magazines unenforceable within the state’s boundaries. HB1076 states that state officials and subdivisions “may not adopt a rule, order, ordinance, or policy under which the entity enforces, or by consistent action allows the enforcement of, a federal statute, order, rule, or regulation enacted on or after January 1, 2013, that purports to regulate a firearm, a firearm accessory, or firearm ammunition if the regulation imposes a prohibition, restriction, or other regulation (such as capacity or size limitation, a registration requirement, or a background check) that does not exist under the laws of this state….No entity described by Subsection (a) and no person employed by or otherwise under the direction or control of the entity may enforce or attempt to enforce any federal statute, order, rule or regulation.” An offense under this Act is a Class A misdemeanor, which carries a penalty of up to $4,000 and one year in prison.

Chumley, Taylor, Smith, et al., H3101 (“South Carolina Freedom of Health Care Protection Act”) states, “The provisions of the Patient Protection and Affordable Care Act of 2010 which exceed the limited powers granted to the Congress pursuant to the Constitution, cannot and should not be considered the supreme law of the land. The General Assembly of South Carolina has the absolute and sovereign authority to interpose and refuse to enforce the provisions of the Patient Protection and Affordable Care Act of 2010 that exceed the authority of the Congress….No agency of the State, officer or employee of this State, acting on behalf of the state, may engage in an activity that aids any agency in the enforcement of those provisions of the Patient Protection and Affordable Care Act of 2010 and any subsequent federal act that amends the Patient Protection and Affordable Care Act of 2010.” H3101 also expressly prohibits the establishment of, and participation in, Obamacare health exchanges.

Gary Herbert, HB187 (Act No. 213) declares that a person is guilty of agricultural operation interference if the person records an image of, or sound from, an agricultural operation under certain circumstances; obtains access to an agricultural operation under false pretenses; or obtains employment at an agricultural operation with the intent to record an image of, or sound from, the agricultural operation. Violators of the law are guilty of a class A misdemeanor and face up to one year in prison.

Haslam, HB0534/SB0802 prohibits public institutions of higher education from denying recognition, privileges or benefits to a student organization or group on the basis of religious content of the organization’s or group’s speech or the manner in which the organization or group determines its organizational affairs.

Shortey and Stanislawski; and signed into law in 2013 by Governor Mary Fallin; HB1060 (see also SB951) states that, “Any court, arbitration, tribunal, or administrative agency ruling or decision shall violate the public policy of this state and be void and unenforceable if the court, arbitration, tribunal, or administrative agency bases its rulings or decisions in the matter at issue in whole or in part on foreign law that would not grant the parties affected by the ruling or decision the same fundamental liberties, rights, and privileges granted under the U.S. and Oklahoma Constitutions, including but not limited to due process, freedom of religion, speech, or press, and any right of privacy or marriage as specifically defined by the Constitution of this state.” HB1060 would prevent the use and application of U.N. laws or Sharia Law in state court decisions.

Sponsored by Sen. Beason, SB403 would prohibit the State Board of Education from adopting and the Department of Education from implementing the Common Core State Standards developed by the Common Core State Standards Initiative. The bill would also prohibit the State Board of Education, the Department of Education, and other state bodies from compiling or sharing data about students or teachers, except under limited circumstances.

Beshear’s veto, HB279 (Public Act Ch. 111) states, “Government shall not substantially burden a person’s freedom of religion. The right to act or refuse to act in a manner motivated by a sincerely held religious belief may not be substantially burdened unless the government proves by clear and convincing evidence that it has a compelling governmental interest in infringing the specific act or refusal to act and has used the least restrictive means to further that interest. A ‘burden’ shall include indirect burdens such as withholding benefits, assessing penalties, or an exclusion from programs or access to facilities.”
